The Capstone Trading Systems https://www.capstonetradingsystems.com website (the "Site") is comprised of various web pages operated by Capstone Trading Systems. https://www.capstonetradingsystems.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Capstone Trading Systems https://www.capstonetradingsystems.com is an E-Commerce Site.

Capstone Trading Systems is a trading systems developer and market researcher specializing in the research and development of quantitative trading strategies for active traders in the global financial markets. Capstone Trading Systems develops software that generates fully automated trading system signals that traders can use to make trading decisions. The market strategies are for active traders and are short-term quantitative trading strategies created to provide diversity to traditional investments. The software and services are for active traders and alternative asset managers seeking alpha and managing risk in the financial markets.

The purpose of the Capstone Trading Systems website is to provide education and software subscriptions to active traders. Education is offered through blog posts, videos, books, e-books, and courses. Software subscriptions including indicators, fully automated trading systems, trading system portfolios, and other software tools such as the money management algorithms and portfolio money management algorithms. Software subscriptions are offered under different terms including both recurring annual subscriptions and lifetime subscriptions available for a one-time purchase.

Software subscriptions are closed code intellectual property and are not fully disclosed. There are exceptions to this including some of the e-books, courses, videos provided as educational resources as well as open code software tools such as the money management algorithms, portfolio money management algorithms, and the example strategies included in those products. The software subscriptions provided by Capstone Trading Systems can be traded at the subscriber’s discretion in their own brokerage account. The subscriber's trading decisions are self-directed and are not the responsibility of Capstone Trading Systems. Capstone Trading Systems provides general guidelines and does not provide specific investment advice to its subscriber's. Trading system results between different subscribers can vary based on many different factors.

Capstone Trading Systems provides the research and development and software to Capstone Futures Group, an exempt CTA that trades Separately Managed Accounts (SMA) for Qualified Eligible Participants (QEPs).

PRIVACY

Your use of https://www.capstonetradingsystems.com is subject to Capstone Trading Systems's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

ELECTRONIC COMMUNICATIONS

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Capstone Trading Systems is not responsible for third party access to your account that results from theft or misappropriation of your account. Capstone Trading Systems and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

CHILDREN UNDER THIRTEEN

Capstone Trading Systems does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use https://www.capstonetradingsystems.com only with permission of a parent or guardian.

CANCELLATION/REFUND POLICY

There are no refunds for software subscriptions or products. Software subscriptions and products are licensed within one business day and digitally delivered through email or a download portal with detailed instructions. Email support and all upgrades are included during the term of the subscription.

For software subscriptions, the license is embedded into the code and cannot be remotely revoked once it is delivered. For open code educational products and tools, it is not possible to revoke the ability of the subscriber to continue to use the software once it is delivered since it is open code.

Recurring software subscriptions can be cancelled at any time before the account is billed again to discontinue any of the annual subscription services.

Capstone Trading Systems reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Capstone Trading Systems's sole discretion.

The Service is controlled, operated and administered by Capstone Trading Systems from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. INDEMNIFICATION

TERMINATION/ACCESS RESTRICTION

Capstone Trading Systems reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Texas and you hereby consent to the exclusive jurisdiction and venue of courts in Texas in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Capstone Trading Systems as a result of this agreement or use of the Site. Capstone Trading Systems's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Capstone Trading Systems's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Capstone Trading Systems with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Capstone Trading Systems with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Capstone Trading Systems with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

CHANGES TO TERMS
